Foreign Quota in Bangkok Condos

Foreign Quota in Bangkok Condos

How foreign quota works, why it matters before reservation, and what overseas buyers should verify before signing for a Bangkok condominium.

What foreign quota means

Foreigners can own freehold condominium units in Thailand when the condominium is registered under the Condominium Act and the building has available foreign ownership quota. The foreign quota is generally capped at 49% of the aggregate unit space in the condominium building, not simply 49% of the number of units. This distinction matters because a few large units can use more quota than many small units.

For Bangkok investors, foreign quota is not a small administrative item. It determines whether the ownership transfer can be registered in the buyer’s name at the Land Office. A unit can look suitable on price, rent, and location, but still be unsuitable for a foreign freehold buyer if the quota is full or uncertain.

IBP view: quota confirmation should come before any non-refundable payment. A verbal assurance from a seller or agent is not enough for serious foreign-buyer due diligence.

What to verify before reserving

Juristic confirmation

Ask for written confirmation of available foreign quota from the condominium juristic person where the building is completed and the juristic office is operating.

Land Office transfer route

Your lawyer or transfer representative should confirm that the unit can be registered in the buyer’s foreign name at the relevant Land Office.

FET or bank evidence

Foreign buyers normally need evidence that purchase funds were brought into Thailand in foreign currency, commonly through bank-issued FET documentation or equivalent evidence.

Timing risk

Quota can change between initial enquiry and transfer. This is especially relevant in popular expat buildings and buildings with active resale volume.

Foreign quota due diligence checklist

Check Why it matters Buyer action
Registered condominium status Only registered condominiums provide the usual foreign freehold pathway. Confirm the building and title structure before relying on foreign freehold marketing.
Available foreign quota The Land Office will not register a foreign freehold transfer if the quota is unavailable. Request written evidence and re-check close to transfer.
Funds transfer documentation Foreign purchase money usually needs to be traceable from overseas into Thailand. Coordinate bank wording before transfer, not after funds arrive.
Seller ownership status Buying from a foreign owner and buying from a Thai owner can have different quota implications. Have the title deed and ownership status reviewed before deposit.

Where quota risk is highest

Quota risk is often higher in mature expat buildings, central Sukhumvit properties, riverside luxury stock, and completed projects with strong overseas demand. It can also arise in older buildings where the owner mix has shifted over time. For new launches, developers usually manage foreign allocation internally, but buyers should still get written confirmation of the intended ownership structure and transfer requirements.

Quota should be assessed together with legal due diligence, transfer cost planning, and district investment fundamentals.
